Mediation Services

What is mediation?

Mediation is a form of Alternative Dispute Resolution (ADR) and is actively encouraged by the Courts. ADR refers to different ways of resolving a dispute, other than through the court system. It is often the most flexible and effective way to reach a mutually beneficial resolution, and has the added benefit of being significantly less costly than the alternative of pursuing a case in Court.

 

What does a Mediator do? Why is Mediation different?

 

A Mediator’s role is to act as a “go-between” for the two sides of a dispute. They aim to facilitate discussion between parties whilst preventing any unwanted upset or friction which might in other circumstances aggravate the dispute in question. 

 

Mediation can take place over numerous sessions and has a high success rate.

 

The difference between Mediation and Court action is that a Mediation is a voluntary process that takes place in a private location agreed between the parties.

There is no judge present, only the parties, their solicitor (or barrister) and the Mediator. The Mediation allows for as much time to be taken and discussion to be made, as necessary to reach a resolution. The parties have full control over the process and no decision can be imposed, so this means that the parties involved can’t be intimidated into a decision.

 

Subject to the parties reaching an agreement at mediation, the result of the Mediation agreements can be made as legally binding as the outcome would be in Court, through the execution of a Settlement Agreement.

Freddie Lawson, one of our litigation Directors, is a CEDR accredited Mediator.  A qualified and experienced Mediator, he’s a member and former Chair of Woking Community Mediation Service. He regularly acts as Mediator and conducts numerous mediation sessions throughout the year. 

 

Services we offer

 

We provide and host mediation sessions at our Woking office. We also travel to the parties, the offices of their solicitors, or other premises as requested.

 

We are also able to represent clients at a mediation where a third party independent Mediator is instructed.

We have an excellent success rate. the vast majority of disputes can be resolved in a day and simple disputes can be resolved in less than half a day.
