Pre-marital agreements can provide clarity and certainty for the future for a couple about to enter in to a life-long commitment.

Of course, to many people, these types of agreements can seem to create an un-romantic formality. However, many people seriously consider entering into such agreements as a realistic and positive step. For example, one party may wish to protect a particular asset such as an inheritance or to preserve some money for a child from a previous relationship or marriage. In some situations, one party may be much wealthier than the other party and wants to ring fence certain assets. Perhaps both parties simply want a degree of financial clarity in their relationship.

So, deciding to have such an agreement in place is purely a matter of personal choice. Whatever your reasons for wishing to have a pre-nuptial agreement, our Family Law department can tailor a document to meet your precise requirements.

It should be noted that, currently, pre-marital agreements are not enforceable by the British Courts. Nevertheless, the Courts are attaching more and more weight to them and now lean towards upholding them save only where doing so would be manifestly unfair.
