Lasting Powers of Attorney

Our Personal Legal Services solicitors advise upon, draft, register and revoke powers of attorney for health & welfare and property & financial affairs.

How we can help

Managing your affairs during your lifetime can often become increasingly difficult, so it is sensible to nominate a person(s), whom you trust, to look after your affairs, in the event that you need day to day assistance generally, or in circumstances where you may not be able to look after your own affairs due to lack of mental capacity or otherwise.

At W Davies Solicitors we offer a fixed-fee price for our experienced lawyers to prepare and register your Lasting Powers of Attorney (LPAs) on your behalf. This ensures complete clarity as to the costs involved from the outset.

LPAs allow you to appoint an individual, or individuals, to manage your affairs. They remain valid if you become unable to deal with your own affairs by reason of illness or mental incapacity, allowing your appointed individual(s) to ensure that your property and financial or health and welfare needs are met.

If you do not have LPAs in place and you lose your mental capacity, your family members will have no alternative but to make an application to the Court of Protection for a Deputyship Order, to enable them to deal with your affairs, whether financial or medical. This is a lengthy and very costly process, which can add to the stress and anxiety your loved ones may already be experiencing.

You may already have an Enduring Power of Attorney (EPA), which is the document that preceded LPAs. Any EPA validly executed prior to 1st October 2007 can still be used.
